Dae Nova Enterprises, a Washington LLC, d/b/a Active Authenticity Partners (“AAP”) provides websites, including www.evapapp.com and its subdomains (collectively, the “Websites”), online learning courses, including the Active Authenticity Courses (collectively, the “Courses”, and each, a “Course”), and other online services (collectively, with the Websites and Courses, the “Services”).

This Privacy Policy (this “Policy”) sets forth how AAP collects, uses, protects, stores, and otherwise processes your Personal Information (defined below). This Policy does NOT apply to information AAP collects offline or you provide to or is collected by any third party (except as otherwise provided below).

1.    What types of Personal Information does AAP collect?

AAP may collect different types of information from you depending on how you use the Services, including Personal Information. “Personal Information” means information that relates to an identified or identifiable natural person.

For example, AAP may collect your first and last name, email address, postal address, telephone number, sensory information (e.g., audio and visual), IP address, payment information, location information, information on your interaction with the Websites, and information from the content that you share publicly in a Course or from the content that you share directly in your communications with AAP, among other categories of Personal Information.

AAP may also collect information that does not generally identify you but may become associated with your account. AAP may use information that does not identify you for any permissible business purpose under applicable law.

2.    From what sources does AAP collect Personal Information?

Directly From You

AAP may collect your Personal Information when you provide it to AAP directly. For example:

·     When you join a Course, AAP may collect your first and last name, email address, postal address, and telephone number.

·      When you use the public functions in a Course, AAP may collect the information you choose to disclose.

·     When you contact AAP or report a problem with the Services, AAP may collect records and copies of your correspondence.

Automatically From You

AAP may collect your Personal Information automatically as you use the Services. For example, AAP may collect your Personal Information as you browse the Websites. For more information about AAP’s use of automatic data collection technologies, please see Section 3 below.

From Third Parties

AAP may receive your Personal Information from or through third parties that help AAP provide or facilitate your access to the Services. For example, AAP may receive your Personal Information from Google, Squarespace, or Stripe.

AAP abides by this Policy when AAP uses Personal Information provided to AAP by third parties. However, AAP does not control the Personal Information that third parties collect or how they use that Personal Information. You should review the third parties’ privacy policies for more information about how they collect, use, and share the Personal Information they obtain and use.

3.    How does AAP use cookies and other automatic data collection technologies?

Cookies

When you visit the Websites, AAP may ask your browser to store a “cookie,” which is a small text file, on your device to remember information about you. Some cookies remain on your computer until you delete them; others, like session ID cookies, expire when you close your browser. These cookies improve your experience by helping AAP better tailor AAP Services to you. Cookies on the Services may also come from third parties. For example, Squarespace may use cookies to collect your Personal Information on AAP’S behalf to analyze your use of the Services.

Google Analytics

AAP uses Google Analytics, a web analysis service of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, US. On a de-identified basis, Google analyzes your use of AAP’s Websites on AAP’s behalf. The information collected by Google in connection with your use of AAP’s Websites is transmitted to a server of Google in the US, where it is stored and analyzed. 4.    For what purposes does AAP collect Personal Information?

•             To provide or improve the Services – AAP may use your Personal Information to process your requests to access the Services and certain of their features and to generally present and improve the Services. For example, AAP may use your Personal Information to improve a Course.

•             To administer the Services – AAP may use your Personal Information for any lawful business purpose in connection with administering the Services. For example, if you reach out to AAP with a customer service inquiry, AAP may use your Personal Information to respond to you or to troubleshoot an issue you reported having with the Services.

•             To market the Services – AAP may use your Personal Information to market the Services to you. For example, when you sign-up for AAP’s newsletter, AAP may send you news and updates about AAP’s products and the Services.

•             In furtherance of legal, health, and safety objectives – AAP may access, use, and share with others your Personal Information for purposes of health, safety, and other matters in the public interest. AAP may also provide access to your Personal Information to cooperate with official investigations or legal proceedings (e.g., in response to subpoenas, search warrants, court orders, or other legal processes). AAP may also provide access to protect AAP’s rights and property and those of AAP’s agents, users, and others including to enforce AAP’s agreements, policies, and  Terms of Use (available at https://www.evapapp.com/terms-of-use).

•             In connection with a sale or other transfer of AAP’s business – In the event all or some of AAP’s assets are sold, assigned, or transferred to or acquired by a company, your Personal Information may be among the transferred assets.

•             As may be described to you when collecting your Personal Information.

5.    In what situations does AAP disclose your Personal Information?

AAP may disclose your Personal Information:

•             To AAP’s service providers such as Stripe;  

•             To AAP’s social media platforms such as Facebook;

•             To AAP’s affiliates;

•             To AAP’s lawyers, consultants, accountants, business advisors, and similar third parties who owe AAP duties of confidentiality;

•             To a buyer or other successor in the event of a sale or transfer of some or all of AAP’s assets in which Personal Information held by AAP pertaining to the users of AAP’s Services is among the assets transferred;

•             To comply with any court order, law, or legal process, such as responding to a government or regulatory request;

•             To enforce any contract AAP may have in effect with you;

•       If AAP believes disclosure is necessary or appropriate to protect the rights, property, or safety of AAP, AAP’s users, or others; and

•             If you have consented to such a disclosure.

6.    How is my Personal Information protected?

AAP protects your Personal Information through a combination of collection, security, and retention policies.

•             Limited retention. AAP only keeps your Personal Information for as long as AAP needs it for business and operational needs or to comply with any statutory, regulatory, or legal obligations. For example, AAP may retain Personal Information collected from you to support customer service inquiries and prevent repeated violations or suspected violations of the Terms of Use if your account has been banned or your access to the Services has been disabled for any reason.

•             Purpose limitation. AAP will use your Personal Information only for the Services you choose to access and for the purposes for which you choose to share it. AAP will respect your requests to start or stop processing your Personal Information for marketing purposes, as well as the types of marketing messages you may wish to receive.

•             Security measures. AAP implements and maintains reasonable security procedures and practices to protect against the unauthorized access, use, modification, destruction, or disclosure of Personal Information. For example, AAP uses one or more of SSL encryption, firewalls, and self-updating anti-virus software. However, please understand that APP’s implementation of security measures as described in this Policy does not guarantee the security of your Personal Information.

Your Practices and Activities

Your practices and activities are likewise very important for the protection your own Personal Information. You can take certain steps to help protect your Personal Information, such as being mindful of what you share publicly in a Course. Users should also not pick a password that is easy to guess and should not share their password. 

Please remember that AAP has no control over what third parties do with the content of your communications and no responsibility or obligation regarding third parties—IF YOU CHOOSE TO MAKE ANY OF YOUR PERSONAL INFORMATION PUBLICLY AVAILABLE THROUGH THE SERVICES, YOU DO SO AT YOUR OWN RISK.

7.    Is a child’s Personal Information collected by AAP?

A “Child” is a person under 13 years old.

AAP understands the importance of protecting Children’s privacy, especially online. Accordingly, the Services are not designed for a Child audience, nor are the subjects or content designed for Children. AAP does not knowingly collect, maintain, use, or disclose Personal Information of any Child. If you are a parent or guardian of a Child who has submitted Personal Information, please contact AAP.

8.    How will AAP notify users of changes to this Policy?

AAP reserves the right to change this Policy from time to time consistent with applicable law. If AAP makes changes to this Policy, AAP will notify you by revising the date at the top of this Policy, and in some cases, AAP may provide you with additional notice (such as adding a statement in a Course or on the homepage of AAP’s Websites, or sending you an email notification).
